Any materially significant changes to this policy will be posted on the Oswego Consulting Partners website (the “Website”). Oswego Consulting Partners reserves the right to change the terms or contents of its “Privacy Policy” at any time. Users of Oswego Consulting Partners understand and agree that for the most complete and current information regarding Oswego Consulting Partners Privacy Policy that they will need to review the policy each time they intend to use or access the Website or Oswego Consulting Partners services (the “Services”).

Oswego Consulting Partners has developed this Privacy Policy to protect the personal information held by Oswego Consulting Partners and is responsible for personal information under its control. The Privacy Officer is accountable for Oswego Consulting Partners’ compliance with this Privacy Policy.  

Purpose for collecting and using information

Before or when any personal information is collected, Oswego Consulting Partners will identify why it is needed and how it will be used. Oswego Consulting Partners uses the information to follow-up on inquiries through its Website. Oswego Consulting Partners uses the information provided by Users in order to understand and respond to their inquiries. Oswego Consulting Partners may also use User information to verify the validity of the information provided by its Users to help protect against error, fraud, theft or damage to either Oswego Consulting Partners or its Users. Oswego Consulting Partners collects information such as IP addresses and page URLs in order to identify actual or potential technical errors with its website and services. Oswego Consulting Partners may collect the User’s email address, phone number to send follow-up messages.  Oswego Consulting Partners will also use personal information for any other purpose for which the Users provides consent.

Consent

Oswego Consulting Partners will obtain User’s consent before or at the time it collects User’s personal information except where it is impossible or impractical to do so. By using or accessing Oswego Consulting Partners the User accepts and consents to the terms of Oswego Consulting Partners Privacy Policy. The Collection and use of Personal Information

Oswego Consulting Partners collects only the information that the User provides and will use that information for the purposes that Oswego Consulting Partners identifies. Such information includes the content from Users when they directly contact Oswego Consulting Partners. Oswego Consulting Partners does not collect personal information indiscriminately.

Except in select circumstances, personal information will only be retained for as long as needed for the purpose for which it was provided. Circumstances in which information would be kept for extended periods of time would include instances where information is retained, disclosed and used as may be required in order to comply with legal requirements and obligations including legislative requirements, court orders, subpoenas, or to ensure the safety of Oswego Consulting Partners, its Users, staff or the general public or other any other such requirements.

All of the personal information collected by Oswego Consulting Partners will be done by fair and lawful means.

Oswego Consulting Partners will only use personal information for the purpose for which it was collected unless the individual consents otherwise or the use or disclosure is authorized by law. Oswego Consulting Partners will provide Users with reasonable access to their personal information.

Oswego Consulting Partners endeavours to ensure that the personal information that it holds will be as accurate and complete as necessary for the purposes for which it is to be used. Please advise Oswego Consulting Partners promptly of any changes to or inaccuracies in personal information.

Personal Information Protection and Security

Oswego Consulting Partners stores its information on BlueHost servers located in the United States and elsewhere. These servers employ various security measures including a SSH Secure Shell Access. For more detailed information about the security used by BlueHost please review the following link and the sublinks on www.bluehost.com.  For more information on security, please contact BlueHost.  With the exception of emails, Oswego Consulting Partners only maintains digital copies of the User’s personal information on the BlueHost servers that Oswego Consulting Partners uses. Emails sent to Oswego Consulting Partners and phone numbers provided to Oswego Consulting Partners are also stored on the computer of the staff of Oswego Consulting Partners. Access to Oswego Consulting Partners’ digital records of private information is protected by password access and this access is restricted to contractors working for Oswego Consulting Partners.

Emails sent to Oswego Consulting Partners along with the phone numbers of persons who call Oswego Consulting Partners are stored on multiple computers. These computers are only accessible by the staff at Oswego Consulting Partners.  These computers have password protection. Files on these computer are backed up by CrashPlan (http://www.crashplan.com/). CrashPlan stores its information on servers located in the United States and elsewhere. CrashPlan utilizes a multi-layered security model that includes transmission security, account security (access), password security, encryption security and secure messaging. CrashPlan runs within the confines of a secure Java virtual machine and all of its cryptographic functions rely on the industry standard Cryptographic Extensions (JCE) provided therein.

Openness, Questions and Complaints

Oswego Consulting Partners is committed to being open regarding its privacy practices and its use and management of personal information. Should the User have any questions or inquiries regarding the User’s personal information the User may contact Oswego Consulting Partners’ Privacy Officer at privacyofficer@ocpp.ca.

Should the User wish to make any changes to the User’s personal information, access the User’s personal information, make any inquiries or complaints regarding the User’s personal information or challenge Oswego Consulting Partners’ compliance with this Privacy Policy, please contact Oswego Consulting Partners’ Privacy Officer at privacyofficer@ocpp.ca. Oswego Consulting Partners will provide Users with reasonable access to their personal information. Oswego Consulting Partners commits to investigating all complaints received and, if and where necessary, taking appropriate measures to correct information handling practices and policies. If the User is not satisfied with the way that Oswego Consulting Partners has responded to the User’s inquiry or complaint, the User may address the concern to the Privacy Commissioner of Canada (http://www.priv.gc.ca/index_e.asp) or to the Information and Privacy Commissioner of British Columbia (http://www.oipc.bc.ca/).

Third Party Websites

Users who click on links or access information on Oswego Consulting Partners Website that result in the User accessing third party websites do so at their own risk and Oswego Consulting Partners does not assume any liability or responsibility for the privacy practices, services or actions of those third party websites. Oswego Consulting Partners recommends that Users review the privacy policies of each website that they view or use.

Jurisdiction

By using or accessing Oswego Consulting Partners the User agrees that the use of the site and this policy will be governed by the laws of the Province of British Columbia and the Federal laws of Canada where and when applicable.  The User acknowledge and agree that the User’s personal information may be stored on servers located outside of Canada including, but not necessarily limited to, the United States, and as such, may also be subject to the laws of those jurisdictions.

The User agrees that any legal dispute between the User and Oswego Consulting Partners, whether arising from a section of these terms of use or otherwise, will be dealt with exclusively by the Courts of British Columbia Canada, in the location of Victoria British Columbia, and in accordance with applicable Canadian law.

Any dispute will be handled between the User and staff at Oswego Consulting Partners. If the dispute is legal in nature, the dispute will be handled by arbitration in Victoria, British Columbia, Canada.  The User agrees to handling disputes first with staff at Oswego Consulting Partners, and if necessary, then in arbitration in Victoria, British Columbia, Canada.  The User agrees that it will not bring disputes to other locations, nor by other legal means. Any damages payable to the User will be less than any payment made by the User to Oswego Consulting Partners.

 Languages

Should this website be translated into any other language and should there be any conflict with the English version of this Privacy Policy and any other language, the English version shall prevail.
